These Terms & Conditions (“Terms”) govern your use of the services provided by Slowpoke Tattoo, a licensed tattoo studio located in Austin, Texas (“Studio,” “we,” “our,” or “us”). By booking an appointment, completing an intake form, or receiving services at our studio, you agree to be bound by these Terms. Please read them carefully.


Acceptance of Terms

These Terms constitute a legally binding agreement between you (“Client”) and Slowpoke Tattoo. By scheduling an appointment, paying a deposit, signing a consent or intake form, or receiving services from us, you acknowledge that you have read, understood, and agree to these Terms in full.


We reserve the right to update or modify these Terms at any time. The most current version will be posted on our website with a revised effective date. Continued use of our services following any update constitutes your acceptance of the revised Terms.

These Terms apply to all services provided at our Austin, Texas studio location(s), including tattoos, consultations, and any related services.

Services Description

Slowpoke Tattoo provides professional tattoo services performed by licensed artists in compliance with Texas Health & Safety Code Chapter 146 and applicable City of Austin and Travis County health regulations. Our services include:

Custom and pre-designed tattoo application

Design consultations (in-person and remote)

Cover-up and rework services

Touch-up services (subject to artist policy)


Service Discretion

We reserve the right to decline or discontinue service at any time at our sole discretion, including but not limited to situations where:

A client appears to be under the influence of alcohol or controlled substances

A client exhibits behavior that is threatening, harassing, or disruptive to staff or other clients

A client’s health condition presents an unreasonable risk

Placement or design would violate ethical standards or professional judgment

Required identification or health disclosures are not provided


In such cases, deposits may be forfeited at the studio’s discretion.


Results Disclaimer

Tattoo outcomes are influenced by many individual factors including skin type, tone, texture, placement, lifestyle, sun exposure, and personal healing response. While we strive for the highest quality results, we cannot guarantee that the final healed result will match preliminary designs, digital mockups, or reference images exactly. We encourage open communication during the design process to ensure alignment with your expectations.


Age Requirements & Identification

All clients must present a valid, unexpired, government-issued photo identification (e.g., driver’s license, state ID, passport) before any service is performed. This requirement cannot be waived.

A photocopy of the presented ID will be retained in our records as required by law. Presenting false or fraudulent identification is a violation of Texas Penal Code and releases the Studio from any and all liability related to the service provided.


In accordance with Texas state law, our studio maintains a strict age policy to ensure the safety and legal protection of our clients and artists:

Adults (18+): Individuals aged 18 and older may receive tattoo services. A valid, government-issued photo ID is required at the time of service.

Minors (Under 18): We cannot legally tattoo anyone under the age of 18, regardless of parental consent or presence.

The Limited Exception: Per §146.012(a-1), a tattoo may only be performed on a minor if it is intended to cover an existing tattoo that contains:

Obscene or offensive language/symbols; Gang-related names, symbols, or markings; Drug-related symbols; or Other words or symbols that a parent or guardian determines are in the best interest of the minor to cover.


Appointments, Deposits & Cancellation Policy

Booking & Deposits

A non-refundable deposit is required to reserve your appointment date and time. The deposit amount varies by artist and project scope and will be communicated at the time of booking. Deposits are applied toward the total cost of your tattoo.

Cancellation: Must be made at least 48 hours before your scheduled appointment to reschedule without forfeiting your deposit.

No-Show: Clients who do not appear and do not provide advance notice will forfeit their deposit entirely. A new deposit is required to rebook.

Late Arrival: Arrivals more than 15 minutes late may result in rescheduling at artist’s discretion, with possible deposit forfeiture

Rescheduling: One reschedule is permitted with sufficient notice. Deposits do not carry over after a second reschedule request.


Pricing

Tattoo pricing is based on size, complexity, placement, time, and artist. Hourly rates or flat project rates will be quoted during your consultation. Quoted prices are estimates; final pricing reflects actual time and complexity. All pricing is discussed and agreed upon before the appointment begins.


Appointment Preparation

To ensure the best possible experience and result, clients should:

Arrive well-rested and have eaten a full meal within 2–3 hours of their appointment

Stay well-hydrated in the days leading up to the appointment

Avoid alcohol for at least 24 hours before the appointment

Avoid excessive sun exposure or sunburn on the area to be tattooed

Wear or bring clothing that allows easy access to the area to be tattooed

Avoid applying lotions, oils, or makeup to the area on the day of the appointment


Health Disclosure & Client Responsibility

Receiving a tattoo involves penetration of the skin and carries inherent risks including, but not limited to, infection, allergic reaction, scarring, and adverse healing. You are responsible for providing complete, accurate health information on your intake form prior to receiving any service.


You Must Disclose:

Any known allergies, including to inks, pigments, latex, or topical anesthetics

Current medications, including blood thinners, retinoids, antibiotics, and immunosuppressants

Medical conditions including diabetes, hemophilia, autoimmune disorders, skin conditions (psoriasis, eczema), or history of keloid scarring

Pregnancy or nursing status

Recent surgeries, radiation treatment, or significant illness

Any condition that may impair healing


Important: Providing false, incomplete, or misleading health information releases Slowpoke Tattoo and its artists from all liability arising from complications related to undisclosed conditions. If you are unsure whether a condition or medication affects your ability to be tattooed, please consult your physician before your appointment.

Aftercare Responsibility

Proper aftercare is essential to the healing and quality of your tattoo. Upon completion of your service, your artist will provide written and verbal aftercare instructions. You agree to:

Follow all provided aftercare instructions diligently

Contact us promptly if you observe signs of infection or abnormal healing

Seek medical attention immediately if you experience a severe allergic reaction


The Studio is not responsible for healing complications arising from failure to follow aftercare instructions, pre-existing conditions not disclosed at the time of service, or exposure to environments or activities that compromise healing.

Assumption of Risk & Limitation of Liability

Tattooing is an invasive cosmetic procedure. By proceeding with service, you acknowledge and accept the inherent risks involved.

To the fullest extent permitted by Texas law, Slowpoke Tattoo, its owners, artists, and staff shall not be liable for any indirect, incidental, special, or consequential damages arising from the provision of services, including but not limited to infection, allergic reaction, scarring, fading, or dissatisfaction with results, except where such liability results from our gross negligence or willful misconduct.


Our total liability to you for any claim arising out of or related to services provided shall not exceed the total amount paid by you for the specific service in question.


Indemnification

You agree to indemnify and hold harmless Slowpoke Tattoo, its artists, owners, and employees from any claims, damages, losses, or expenses (including attorney’s fees) arising from: (a) your breach of these Terms; (b) your provision of inaccurate or incomplete health information; (c) your failure to follow aftercare instructions; or (d) your violation of any applicable law.


No Medical Advice

Nothing in these Terms or any communication from our studio constitutes medical advice. Aftercare instructions are industry-standard guidance, not a substitute for professional medical care. Consult a licensed physician for any health concerns related to your tattoo.


Artwork, Design & Intellectual Property

Custom Designs

Custom tattoo designs created by our artists remain the intellectual property of the creating artist. Upon full payment for services, you receive a personal, non-commercial license to the design as applied to your body.

You may not:

Reproduce, sell, or commercially exploit the design without the artist’s written consent

Share the design digitally prior to your appointment in ways that allow third parties to replicate it


Artists retain the right to include the tattoo in their portfolio and to use photos of the completed work (subject to your photo consent preferences on your intake form).


Client-Provided Reference Images

If you provide reference images, logos, or artwork for your tattoo, you represent and warrant that you have the right to use such material and that its reproduction as a tattoo does not infringe any third-party intellectual property rights. You agree to indemnify the Studio for any claims arising from client-provided reference material.


The Studio does not reproduce exact copyrighted designs, logos, or trademarked imagery belonging to third parties. Our artists may incorporate inspired elements or create original interpretations upon mutual agreement.


Deposits, Payments & Refund Policy

Deposit Policy

All deposits are non-refundable. By paying a deposit, you are reserving artist time and agreeing to the cancellation terms in Section 4. Deposits may be applied to a rescheduled appointment if proper notice (minimum 48 hours) is given and the reschedule occurs within a reasonable timeframe as determined by the artist.


Payment

The remaining balance for services is due in full upon completion of the tattoo session. Accepted payment methods will be communicated at the time of booking. Failure to pay for completed services may result in legal action and/or referral to collections.

Touch-Up Policy

Many artists offer a complimentary touch-up within a specified period (typically 60–90 days) following the original session, subject to the following conditions:

The area has healed fully

Aftercare instructions were followed

The issue is not a result of placement in a naturally high-fade area (hands, feet, fingers, inner lips)

Touch-up policies vary by artist. Please confirm specifics with your artist at the time of your appointment. Touch-ups are not available for work performed at other studios.

No Refunds on Completed Services

By the nature of tattoo services, we do not offer refunds on completed work. If you have concerns about the result of your service, please contact us so we can discuss solutions. We are committed to client satisfaction and will work in good faith to address legitimate concerns.


Studio Conduct & Safety

We are committed to maintaining a safe, respectful, and professional environment for all clients and staff. All clients agree to:

Treat all studio staff and other clients with respect and courtesy

Refrain from arriving under the influence of alcohol or controlled substances

Follow all posted studio safety and hygiene guidelines

Not bring unauthorized guests into service areas

Disclose any communicable conditions (open sores, active skin infections) on or near the area to be tattooed

The Studio operates as a harassment-free zone. We reserve the right to immediately end a session and ask any individual to leave the premises for unsafe, threatening, or harassing conduct. In such cases, the session fee is still owed for time already rendered.

Firearms and weapons are not permitted on studio premises.

Governing Law, Disputes & Severability

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas for the resolution of any disputes arising under these Terms.

Dispute Resolution

Before initiating formal legal proceedings, you agree to contact us in good faith to attempt to resolve any dispute informally. We will make reasonable efforts to resolve disputes within 30 days of receiving written notice.


Waiver of Class Action

To the extent permitted by applicable law, you waive your right to participate in a class action lawsuit or class-wide arbitration against Slowpoke Tattoo.


Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with any intake form, consent form, or written agreement signed at the time of service, constitute the entire agreement between you and Slowpoke Tattoo with respect to the services provided and supersede any prior communications or understandings.
