Slowpoke Tattoo, (“we,” “our,” or “us”) is a licensed tattoo studio located in Austin, Texas. We are committed to protecting the privacy of every client, prospective client, and website visitor. This Privacy Policy describes what information we collect, how we use it, and your rights under applicable Texas and federal law, including the Texas Data Privacy and Security Act (TDPSA), Tex. Bus. & Com. Code Ch. 541 (effective July 1, 2024).

1. Information We Collect

Contact & Booking Information

When you request an appointment, consultation, or contact us through our website, phone, or booking system, we may collect:

Full name, phone number, and email address

Preferred appointment date, time, and artist

Style preferences, reference images, and placement details

Deposit payment confirmation (we do not store full card numbers; see Section 5)


Health & Medical Information

Texas law and sound professional practice require us to collect certain health-related information before providing tattoo services. This may include:

Known allergies (including ink pigments, latex, and topical anesthetics)

Skin conditions relevant to the service area

Current medications (particularly blood thinners, retinoids, and immunosuppressants)

Pregnancy or nursing status

History of keloid scarring or adverse healing responses


Note: Health information is collected for your safety and is treated with heightened confidentiality. It is not sold, shared with advertisers, or used for any purpose other than delivering or improving your service.

Identification & Age Verification

We are required by Texas Health & Safety Code §146.012 to verify that clients are at least 18 years of age. We collect a copy of a valid government-issued photo ID for this purpose.

In accordance with Texas state law, our studio maintains a strict age policy to ensure the safety and legal protection of our clients and artists:


Adults (18+): Individuals aged 18 and older may receive tattoo services. A valid, government-issued photo ID is required at the time of service.

Minors (Under 18): We cannot legally tattoo anyone under the age of 18, regardless of parental consent or presence.


The Limited Exception: Per §146.012(a-1), a tattoo may only be performed on a minor if it is intended to cover an existing tattoo that contains:

Obscene or offensive language/symbols; Gang-related names, symbols, or markings; Drug-related symbols; or Other words or symbols that a parent or guardian determines are in the best interest of the minor to cover.


Photography & Portfolio Images

With your explicit written consent, we may photograph completed work for portfolio, social media, or promotional purposes. See Section 4 for full details on photo consent.

. How We Use Your Information

We use the information we collect for the following purposes:

Scheduling and service delivery — to book, confirm, and manage your appointments

Client safety — to assess contraindications and provide appropriate aftercare instructions

Legal compliance — to meet requirements under Texas Health & Safety Code Chapter 146 and applicable health codes enforced by the City of Austin and Travis County

Communications — to send appointment reminders, follow-up care instructions, and respond to inquiries

Marketing (only with your consent) — to send promotional offers, newsletters, or feature your work on our portfolio or social media

Business operations — to process payments, maintain records, and improve our services


We do not use your personal information for automated decision-making or profiling that produces legal or similarly significant effects.


3. Health & Sensitive Data

Health information collected in connection with your tattoo service is classified as sensitive personal data under the Texas TDPSA. We handle this information as follows:

It is stored in secured, access-controlled systems (physical intake forms are stored in locked filing systems; digital data is encrypted).

Access is limited to your artist and studio management for purposes directly related to your service.

It is retained for a minimum of two (2) years as required by applicable Texas health and safety regulations, and then securely destroyed.

It is never sold and never shared with third-party marketers, data brokers, or insurers.


Texas TDPSA Notice: Sensitive personal data (including health data) requires your consent before we may process it for purposes beyond those necessary to provide the requested service. By completing a consent and health intake form, you authorize us to use that information to safely perform your tattoo service.


4. Photography & Portfolio Use

We may wish to photograph finished tattoos for use in our artist portfolio, studio social media (Instagram, Facebook, TikTok, etc.), our website gallery, or promotional materials. Photo consent is entirely voluntary. Declining will not affect the quality of service you receive.

We will ask for your written consent on your intake form before the appointment. If you consent, photos may show the tattooed area. We do not publish images that identify your face without additional explicit consent. You may withdraw consent for future use at any time by contacting us in writing. Previously published photos cannot be retroactively removed from third-party platforms, but we will not use new photos following your withdrawal. We do not sell client images to third parties.


5. How We Share Your Information

We do not sell your personal data. We share information only in the following limited circumstances:


Service Providers

We may share limited data with trusted vendors who help us operate our business, including our appointment scheduling platform, payment processor, and email service provider. These vendors are contractually prohibited from using your data for their own purposes.

Payment Processing

Deposits and payments are processed through a PCI-DSS compliant third-party payment processor. We do not store full credit card or debit card numbers on our systems.

Legal Obligations

We may disclose information when required to do so by law, subpoena, court order, or governmental authority, or to protect the rights, safety, and property of our studio, clients, or the public.

Business Transfers

In the event of a merger, acquisition, or sale of studio assets, client records may be transferred to the acquiring party. We will provide notice before your information becomes subject to a different privacy policy.

We Never Sell or Share With

Advertising networks, data brokers, or marketing platforms

Insurance companies or employers

Any party for purposes inconsistent with this policy


6. Your Privacy Rights (Texas TDPSA)

As a Texas resident, you have the following rights regarding your personal data under the Texas Data Privacy and Security Act (Tex. Bus. & Com. Code Ch. 541, effective July 1, 2024):


Right to Know — confirm whether we process your personal data and access a copy of it

Right to Correct — request correction of inaccurate personal data we hold about you

Right to Delete — request deletion of personal data, subject to legal retention requirements

Right to Portability — obtain a copy of your data in a portable, readily usable format

Right to Opt Out — opt out of the sale of personal data, targeted advertising, or profiling (we do not engage in these activities)

Right to Appeal — appeal our decision if we decline to act on a rights request within 45 days


To exercise any of these rights, submit a request to us using the contact information in Section 9. We will respond within 45 days of receiving a verifiable request (extendable by an additional 45 days with notice). We will not discriminate against you for exercising these rights.


Sensitive Data Consent

For sensitive personal data (health information, government ID), we obtain consent before collection. You may withdraw consent at any time; however, withdrawal may affect our ability to provide services to you.


7. Data Security & Retention

We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, disclosure, and misuse. These measures include:

Locked, access-controlled storage of physical intake forms and ID copies

Encrypted digital storage where personal data is held electronically

Limited employee access on a need-to-know basis

Use of reputable, security-reviewed third-party platforms for booking and payments


No method of transmission or storage is 100% secure. If you believe your information has been compromised, please contact us immediately.


Retention Periods

Client intake and health forms: Minimum 2 years per Texas health and safety regulations, then securely destroyed

ID verification records: Retained as required by Texas Health & Safety Code §146.012

Payment records: 7 years for tax and accounting purposes

Marketing communications: Until you opt out or request deletion


8. Minors & Cookie Policy

We do not knowingly collect personal information from children under the age of 13. Our website is not directed to children. If you believe a child under 13 has provided us with personal information, please contact us and we will promptly delete it.

Our website may use cookies and similar technologies for analytics, session management, and booking functionality. You may control cookie settings through your browser. Disabling certain cookies may affect website functionality. We do not use cookies for behavioral advertising.
